KIKS Terms of Use

This page sets out the terms for using the KIKS service, including lesson videos, learning audio, practice quizzes, assignments, the Practice Bank, Mock Tests, and the learning platform.

These Terms of Use are the terms for using the KIKS (Kakehashi International Korean System) Korean-learning service. In this document, KIKS is referred to as "the Service."

The Service includes the members-only learning website, lesson videos, practice quizzes, assignments, learning audio, progress-management features, and other related services.

Users must agree to these Terms before using the Service.

Article 1 Purpose of the Service

The purpose of the Service is to support learners — in particular Cambodian learners — in studying Korean, preparing for the EPS-TOPIK exam, learning practical Korean for work, building a study habit, and studying independently online.

The Service is a study-support service. The Service does not guarantee that a user will pass an exam, obtain a job, obtain a visa, be able to travel to Korea, earn income, or achieve any particular outcome.

Article 2 Scope of these Terms

These Terms apply to everything related to the Service, including:

  1. The KIKS website and the members-only pages
  2. The BASIC, SILVER, GOLD, and PLATINUM plans and any EPS-related plans
  3. Lesson videos
  4. Practice quizzes, assignments, the Practice Bank, and Mock Tests
  5. Learning audio, images, text, PDFs, and other study materials
  6. Progress-tracking features, lesson unlocking, scores, and study history
  7. Features connected with Telegram, Google Drive, Vimeo, WordPress, MemberPress, LearnDash, and other services
  8. All other content and features related to the Service

Article 3 Member Registration

Users must provide accurate and current information when registering to use the Service.

If registered information is found to be false, incorrect, or incomplete, the Service may suspend use, delete the registration, or limit support.

Users are personally responsible for managing their account, login information, and password.

Article 4 Account Management

Users may not lend, transfer, share, sell, rename, or use an account jointly with another person.

An account may only be used by the registered account holder.

Sharing login information with family, friends, colleagues, schools, or any other third party is prohibited.

If unauthorized account use, account sharing, or use of an account by multiple people is discovered, the Service may suspend the account, restrict its use, or delete the membership without prior notice.

Article 5 Fees and Payment

Users must pay the fee for the plan they select.

The payment method, payment deadline, access period, and plan content follow the information shown on the plan page or other relevant information pages.

Once payment has been made, cancellation, a refund, a plan change, or an extension of the access period for reasons personal to the user is generally not possible. However, exceptions may be made where the Service specifically agrees to them.

If there is a payment problem, non-payment, unlawful payment, or an improper refund claim, the Service may suspend use.

Article 6 Plan Content

The content of each plan follows the description on that plan's information page.

BASIC and SILVER are, in principle, self-paced courses. Unless a plan explicitly states otherwise, personal questions about lesson content, correction of answers, or direct teaching from a teacher are not included.

Basic support is limited to:

  1. Login issues
  2. Payment issues
  3. Account issues
  4. System issues
  5. Video or audio playback issues

For GOLD, PLATINUM, and other special plans, separately defined terms apply.

Article 7 Scope of Use of Course Content

Users may use the videos, audio, practice quizzes, assignments, text, images, documents, learning platform, and other content only within the scope permitted by the Service.

Content from the Service may be used only for the user's own personal study purposes.

The following actions are prohibited:

  1. Video-recording, audio-recording, photographing, or taking screenshots of content
  2. Downloading, copying, saving, or re-posting content
  3. Sharing content to social media, Telegram, Facebook, YouTube, TikTok, Google Drive, or other platforms
  4. Sending, selling, lending, or transferring content to a third party
  5. Unauthorized use in a school, company, organization, class, or other course
  6. Using any part or all of the content to create another service
  7. Sharing practice-quiz or assignment content, answers, explanations, audio, or video URLs externally
  8. Creating study materials, courses, apps, or other websites by copying or modeling them on the Service

Article 8 Intellectual Property

All rights in the Service belong to the operator of the Service or to lawful rights holders. These rights include:

  1. Lesson videos
  2. Learning audio
  3. Practice quizzes, assignments, the Practice Bank, and Mock Tests
  4. Text, explanations, translations, example sentences, and commentary
  5. Images, UI design, and page layout
  6. The curriculum, lesson structure, and lesson-unlocking structure
  7. Progress management, scoring, analytics, and evaluation methods
  8. The brand name, logo, service name, and plan names
  9. Databases, ledgers, and management tables
  10. The system architecture, code, configuration, and operational know-how

Using the Service does not grant the user any intellectual property rights whatsoever.

Article 9 Prohibition on Recording, Copying, and Saving

Users may not video-record, audio-record, photograph, copy, or save any video, audio, learning screen, practice quiz, assignment, or explanation within the Service.

This prohibition covers screen recording, screenshots, recording with an external camera, recording with a smartphone, and recording audio with a voice-recording app.

If this Article is violated, the Service may suspend the account, claim compensation for damages, or take legal action.

Article 10 Prohibition on Sharing and Re-posting

Users may not share content from the Service with any third party.

In particular, the following forms of sharing are prohibited:

  1. Posting in a Telegram group
  2. Posting on Facebook, TikTok, YouTube, or other platforms
  3. Uploading to Google Drive, Dropbox, or other storage services
  4. Sharing within a school, company, sending organization, or class
  5. Sending to friends, family, or colleagues
  6. Sharing answers, practice-quiz content, or assignment content
  7. Sharing login information

Article 11 Prohibition on Unlawful Use

Users may not do any of the following:

  1. Use another person's account
  2. Use a single account jointly among multiple people
  3. Access the system without authorization
  4. Analyze, modify, or reverse-engineer the system
  5. Use automated tools, bots, or automated data scraping
  6. Place an excessive load on the server, system, or network
  7. Interfere with the operation of the Service
  8. Register using false information
  9. Disturb or cause problems for other users
  10. Act in violation of the law or public morals

Article 12 No Guarantee of Learning Outcomes

The Service is a support service for learning Korean.

The Service does not guarantee any of the following outcomes:

  1. Passing the EPS-TOPIK or any other exam
  2. Obtaining a job in Korea
  3. Obtaining a visa
  4. Passing an interview
  5. Reaching a particular language level
  6. Any outcome related to income, employment, study, or travel
  7. Learning effectiveness, score improvement, or sustained continuation of study

Learning outcomes depend on study time, effort, comprehension, environment, equipment, internet connection, and individual differences.

Article 13 Changes to Service Content

The Service may change, add to, suspend, or discontinue content, lesson structure, practice quizzes, assignments, pricing, plan content, features, design, or the manner of providing the Service, as needed.

The Service has no obligation to provide a refund or other compensation as a result of the changes described above, unless required by law.

Article 14 Suspension or Interruption of Service

The Service may suspend or interrupt all or part of the Service without prior notice in the following cases:

  1. System maintenance
  2. Server issues
  3. Network or internet-connectivity issues
  4. External-service issues
  5. Issues with Vimeo, Google, WordPress, MemberPress, LearnDash, or other services
  6. Disasters, power outages, accidents, or other factors beyond the Service's control
  7. Cases the Service judges necessary for its operations

The Service is not liable for damages arising from a suspension or interruption of the Service.

Article 15 Use of External Services

The Service may use external services such as Vimeo, Google, Telegram, WordPress, MemberPress, LearnDash, and payment providers.

Changes to an external service, its suspension, technical issues, account restrictions, or changes to that external service's own terms of use may affect the Service.

The Service is not liable for damages arising from an external service.

Article 16 Measures for Violations of these Terms

If a user violates these Terms, the Service may take the following measures:

  1. Issue a warning
  2. Temporarily suspend use
  3. Suspend the account
  4. Delete the registration
  5. Restrict use of content
  6. Refuse to refund fees already paid
  7. Claim compensation for damages
  8. Take legal action
  9. Report the matter to a relevant authority

Article 17 Compensation for Damages

If a user violates these Terms and causes damage to the Service or to a third party, the user is responsible for compensating that damage.

In particular, if unauthorized copying, re-posting, selling, sharing, account sharing, or unlawful use of study materials causes damage, the Service may claim compensation from the user.

Article 18 Handling of Personal Information

The Service may use a user's registration information, study history, payment information, inquiry content, and access information to provide the Service, verify identity, manage learning, provide support, improve the Service, and prevent unlawful use.

Details of how personal information is handled follow the separately defined Privacy Policy.

Article 19 Use of Learning Data

The Service may use a user's study history, practice-quiz results, assignment status, video-viewing status, progress, and level-check results for the following purposes:

  1. Showing study progress
  2. Determining lesson unlocking
  3. Analyzing study status
  4. Improving the Service
  5. Improving study materials
  6. Preventing unlawful use
  7. Responding to support requests

Data that has been processed into statistical form and can no longer identify an individual may be used to improve the Service or to produce related documents.

Article 20 Withdrawal of Membership

Users may request to withdraw their membership through the method specified by the Service.

After withdrawal, the user may no longer use members-only content.

After withdrawal, fees already paid are, in principle, not refunded.

Even after withdrawal, the provisions on intellectual property, prohibited acts, compensation for damages, and disclaimers of liability remain in effect.

Article 21 Changes to these Terms

The Service may change these Terms as needed.

Amended Terms take effect from the time they are published on the Service, or from a time separately specified by the Service.

If a user continues to use the Service after these Terms have been amended, the user is deemed to have agreed to the amended Terms.

Article 22 Governing Law and Disputes

The interpretation and application of these Terms follow the law of the jurisdiction where the Service operator is located, or the law specified by the Service.

If a dispute related to the Service arises, the user and the Service shall discuss it in good faith to seek a resolution.

If necessary, a court or dispute-resolution body with competent jurisdiction may be separately designated.

Article 23 Inquiries

Questions regarding these Terms should be directed through the contact channel specified by the Service.

Article 24 Special Provisions

The Service is an online learning service intended to support education.

KIKS's videos, audio, practice quizzes, assignments, learning platform, curriculum, translations, design, system design, and operational know-how are important intellectual property belonging to KIKS.

Users must respect this intellectual property and use it only for their own personal study purposes.
